Labor begins an offensive against labor fraud in the etts

The Work inspection a specific campaign will begin this Monday to prosecute fraud in the temporary employment agencies (ETT). This was announced by the second vice president, Yolanda Diaz, this Saturday in an act of Sumar in Las Palmas de Gran Canaria. Almost 250 companies –like Randstad, Adecco o Manpower– and 2.3 million contracts signed per year will be in the crosshairs of the ‘labor police’ in the coming months.

The new one labour reform, which this March celebrates one year and one quarter of validity, reinforced the weight of temporary employment agencies, with the aim of limiting the indiscriminate use of temporary contracts. The new rules enable the possibility for these companies to offer discontinuous fixed contracts to its employees, in order to later make them available to a third company and in periods of inactivity not to break, but to suspend, the contractual relationship of the employee and the ett. Until now, in general, the contractual relationship of the worker with the ett lasted as long as the need for the third company lasted.

Although Díaz has not given more details about the scope and methods of the new Inspection campaign, monitoring the correct use of these discontinuous permanent contracts will probably be one of the objectives. And it is that for the year 2023 the correct management of this contractual formula is a priority in all companies for the ‘labor police’

Until now, companies or employment agencies have not been within the priority focus of the ‘labor police’, according to the data collected by the last annual report of the organization. In 2021, the inspectors carried out a total of 415 actions on these companies throughout Spain, finding irregularities in 25% of them. And they issued proposals for sanctions worth 404.689 euros.

Every month around 190,000 workers are made available to third-party companies through an ett, 32,000 of them are located in Catalonia. And, by sector, the presence of intermediation companies is located in the manufacturing industry, with 28.2% of the total contracts signed; in agriculture, livestock and fishing (17.8%); transport (17.5%) and hospitality (12.3%), according to the latest data from the Ministry of Labour.
