Labor lawsuits must be reported on eSocial from April

The e-Social platform has updates expected to come into effect in April 2023. These are the launch of new events related to labor processes.

It is worth mentioning that the sending of this information to eSocial will be released from April 1, 2023. As published by the Federal Government, the S-1.1 version of eSocial, as pervisa, was implemented on January 16th, but the Labor Process events will only be available for submission from April.

The following must be sent: labor proceedings whose decisions became final from January 1, 2023 onwards; court agreements ratified as of this same date; processes whose decision ratifying the settlement calculations was issued as of that same date, even if its final and unappealable decision occurred on an earlier date; and agreements within the scope of the Prior Conciliation Commission (CCP) or Inter-Union Nucleus (Ninter) also entered into from that date onwards.

This information is intended to replace the sending of Sefip code 650 and the collection of labor claims by GPS, in addition to enabling the entry of the FGTS Digital.

The collection of amounts related to labor claims will be generated by DCTFWeb. Regarding the FGTS, the Sefip 650/660 will continue to be sent until the FGTS Digital goes into production.

Elaine comments that sending this information becomes more complete and requires attention on the part of the human resources sector, as the events must be released according to the data from the labor process.

Events to be launched on e-Social

Check below the events that will be received from April 2023:

  • S-2500: Through these events, information on labor processes must be sent, as well as demands and agreements with the CCP or NINTER.

Term: Until the day 15th of the following month to the finality of the decision.

Key: The event will be identified using the following set of data: CNPJ/CPF of the declarant, worker’s CPF and case number.

Prerequisites: sending the S-1000 event, in addition to rectifications and inclusions of events related to the worker, according to the guidelines of the eSocial Guidance Manual (MOS).

  • S-2501: at this event, the amounts of personal income tax and social security contributions will be declared, including those destined to third parties recognized by court order.

Term: Until the day 15 of the month following payment.

Key: CNPJ ROOT/CPF of the declarant, case number and payment jurisdiction.

Attention: An S-2501 event must be sent for each labor process, regardless of the number of workers included in that process as part. If installments are paid, an event must be generated for each paid installment.

  • S-3500: through this event it is possible to delete/cancel S-2500 or S-2501 records

Term: no set deadline.

Key: delivery receipt, worker’s CPF and data of the event to be deleted.

Attention: The form in question does not rectify the information, it deals with the exclusion of events S-2500 or S-2501 definitively (makes these events ineffective). Thus, when used, it is necessary to resend all the information in the e-Social.

  • S-5501: return after processing the S-2501.
