Lawsuit against São Camilo Hospital regarding IUD rejected – 02/02/2024 – Science and Health

Judge Otavio Tioiti Tokuda, of the 10th Vara da Fazenda Pública of the Court of Justice of São Paulo (TJ-SP), rejected a precautionary measure against the São Camilo Hospital with the argument that the use of contraceptive methods “for the mere search of sexual pleasure” challenges Christian morality. The Feminist Caucus, collective mandate of the PSOL party in the Municipal Chamber of São Paulo, presented a lawsuit so that the court would force the health institution to insert IUDs (intrauterine device) in patients.

The Catholic-oriented hospital has a directive not to perform contraceptive procedures due to its religious values. “As is known, life is an inviolable right for the Catholic, even in the defense of the unborn, and the search for contraceptive methods impedes the right to life, by mere search for sexual pleasure, a situation that challenges Christian morality,” the judge said when rejecting the precautionary measure.

Justice has to analyze the merit of the claim. In it, the Feminist Caucus affirms that the institution provides services to the SUS (Single Health System) and should be subject to the rules of public law.

Sociedade Beneficente São Camilo is the maintainer of approximately 40 hospitals in the country, many of which also serve through the SUS. There are also public hospitals managed by the entity through agreements with municipalities and states. However, the judge rejected the argument.
