Lindsay Clancy Defense Seeks Dismissal of Murder Charges

Lindsay Clancy returned to Plymouth Superior Court on Monday as her attorneys urged a Massachusetts judge to dismiss murder charges against her. The case follows a mistrial in September after a jury deadlocked on three murder counts related to the 2023 strangulation deaths of her three young children.

Defense Arguments for Double Jeopardy and Juror Scrutiny

Clancy’s defense team pressed three distinct motions before Judge William Sullivan during the nearly three-hour hearing on November 2, 2026. Attorney Martin G. Weinberg argued that retrying Clancy would violate constitutional protections against double jeopardy. He contended that Sullivan should have investigated further after receiving two notes from the jury foreperson indicating a lone holdout juror was refusing to follow instructions regarding reasonable doubt.

Weinberg asserted that additional questioning might have uncovered grounds to remove the holdout juror and continue deliberations, thereby avoiding the mistrial declared on September 4, 2026. Another defense lawyer, Kevin Reddington, urged the court to examine the holdout juror’s questionnaire for alleged dishonesty and claimed to have evidence that the juror used a cell phone and researched altruistic filicide during deliberations. During the proceedings, Reddington uttered the juror’s name, Michael Desronvil, in open court, prompting a sharp rebuke from Sullivan, who ordered that the individual be referred to only as Juror Doe.

Following the hearing, Edward Paltzik, another attorney for Desronvil, criticized Reddington’s motions as extreme and asserted that the longtime defense attorney handled legal strategy aggressively. The holdout juror himself had already spoken out in media interviews following the deadlocked verdict, and defense filings sought extensive materials including phone records, call logs, and his confidential jury questionnaire. Patrick Clancy testified in related proceedings that his ex-wife’s mental health declined sharply about a month before the children died, while prosecutors and defense experts disputed whether she understood her actions during the incident.

Prosecution Position and Response to Defense Claims

Assistant District Attorney Jennifer Sprague pushed back against the defense motions, arguing that Sullivan handled the jury notes properly. Sprague maintained that further interrogation during the trial would have amounted to judicial coercion and interfered with the substance of deliberations. If the door is open to examining this juror, it would be open on all jurors, Sprague told the court, according to reporting from the Guardian.

Sprague argued that the holdout juror’s disagreement stemmed from his belief that Clancy was guilty rather than any refusal to deliberate, noting that he had evaluated the evidence and arrived at his conclusion. Prosecutors also asked the court to slap a gag order on Reddington to prevent what they characterized as a carnival atmosphere following his media appearances after the mistrial. Sprague argued that public statements made outside the courtroom were calculated to affect the public’s perception of the case, while the defense countered that such restrictions would be vague and speculative.

Trial History and Current Custody Status

Clancy, 36, has not disputed killing her three children—5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan—at the family’s Duxbury home on January 24, 2023. Her defense maintained at trial that she suffered from severe postpartum psychosis and lacked criminal responsibility, whereas prosecutors argued she acted deliberately and understood her actions were wrong. The first trial ended with an 11-1 jury split in favor of acquittal by reason of insanity before deadlocking.

Clancy remains held at Tewksbury Hospital, where she has resided since 2023 following a suicide attempt from a bedroom window that left her paralyzed from the chest down. Her defense team expressed urgency regarding a resolution. I am not going to have this woman sit incarcerated for the next year or two or three, Reddington told the judge, adding, I want a trial, and I want it with you, and I want it this spring.

Next Court Date and Scheduling Outlook

Judge Sullivan took the defense’s motion to dismiss, the evidence requests regarding the holdout juror, and the prosecution’s gag order motion under advisement. Prosecutors indicated an intention to retry the case if the charges survive the dismissal bid, though Sprague noted that specific charges for a second trial remain undecided pending the judge’s rulings.

Sullivan scheduled the next status hearing for November 16, 2026, at which point he expects to rule on the pending motions. If the case proceeds, Sullivan floated a potential trial start date in March 2027, ahead of his mandatory retirement in June 2027.
