Local government issues decree in favor of public property

He explained that Article 27 of the Political Constitution of the United Mexican States It does not establish private property as a guiding principle, as a fundamental right or as an original right, but rather as a property derived from the original property of the nation.

“The ownership of the lands and waters within the limits of the national territory originally corresponds to the nation, which has had and has the right to transfer ownership of them to the individuals constituting “private property,” the section stipulates.

In this regard, he said that the new reform guarantees respect for private, public and social property; it also makes it more difficult for the judiciary to interpret local regulations in favor of the most powerful economic groups.

“The foundations have been laid for development with a social emphasis, which recognizes the supremacy of the public over any particular interest in Mexico City for the years to come,” he said.

He pointed out that due to the lack of clarity there was a risk that judicial instances interpret the constitutional norms in favor of certain economic groups, putting aside article 27 of the Federal Constitution, to rely on a local provision.

“We consider it very important to make clear in any case that the precept that guides us in the City in terms of property is the one indicated in article 27 of the Political Constitution of the United Mexican States“, he reiterated.

Batres thanked the local Congress for its willingness to address the reform initiatives submitted in recent months, which, he stressed, have been approved.
