jpnn.comJAKARTA – Former vice presidential candidate in the 2024 elections, Mahfud Md. assesses that the Constitutional Court (MK) Decision Number 62/PUU-XXII/2024 regarding the minimum percentage threshold for presidential candidacy must be accepted and obeyed.
Mahfud, who is also the former Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam), believes there are two reasons why all parties must accept and obey the Constitutional Court’s decision.
“First, because there is an argument that the judge’s decision which has been accepted ends the conflict, and must be implemented,” said Mahfud, quoted by ANTARA, Thursday.
Furthermore, he said, this decision must be obeyed because so far it is considered that the threshold has often been used to deprive the people and political parties of their rights to elect or vote.
“Therefore, the Constitutional Court’s verdict is a verdict that could become a new landmark decision,” he said.
He also appreciated the Constitutional Court for having the courage to carry out judicial activism in accordance with the aspirations of the people to build a new balance in the Indonesian state administration.
However, he said, the Constitutional Court had previously always rejected requests regarding this threshold.
Mahfud admitted that before appreciating the current MK decision, he had thought that the threshold should not be determined by the MK.
Mahfud MD asked that the Constitutional Court (MK) decision regarding the threshold for presidential candidacy be accepted and obeyed.
