BOLZANO. The case of returns to the Court of Appeal Manal Benhaddouthe 7-year-old girl who died of a cerebral hemorrhage after colliding with a classmate on the morning of October 9, 2009, in the courtyard of the Martin Luther King elementary school in Bolzano. In civil proceedings, the Province and the Bolzano – Europa 2 comprehensive school were ordered to pay the girl’s family over one million euros.

The sentence was confirmed on appeal, where however the appeal of a teacher was accepted, who, in the first instance, had in turn been ordered to pay part of the compensation. Now the Court of Cassation has accepted the appeal of the Province, maintaining that, in the sentence, there is a flaw in the motivation in the part relating to the call for help.

The expert appointed in the first instance had argued that the symptoms of the child (who vomited after the collision) would not have been so serious as to make it necessary to immediately call 118. A thesis from which the judge had diverged. In the event that the sentence were overturned, the family would have to return the entire amount of compensation.
