Many plants are forbidden on the balcony

by times news cr

A balcony with plants is like an oasis of well-being, especially in the warm season. But not every plant is allowed on the balcony. There are even court rulings that prohibit certain plantings.

No influence on the visual appearance

In general, planting on the balcony is only permitted if the plants do not affect the visual appearance of the outdoor area. In addition, the planting must not cause any structural changes in any way.

Accordingly, landlords may prohibit plants on the balcony if the plants damage the house facade or if this significantly changes the appearance of the property.

Several dishes have already been dedicated to the plants on the balcony. The lawyers shed light on certain plants for rental apartments.

Planting with ivy or wild vine

Ivy is very popular for adding greenery to a balcony. The evergreen and easy-care plant also grows particularly quickly. However, ivy is a climbing plant that requires a trellis to thrive. If the trellis is too small, the plant will grow on the masonry of the house.
Therefore, the Berlin-Schöneberg district court judged ivy to be an unsuitable balcony plant according to a judgment with file number 6 C 360/85. The same ruling applies to wild wine.

Judgments about the maple tree

According to a decision by the Munich Regional Court with file number 31 S 12371716, maple trees may not be planted on a balcony.

During the legal dispute, the roots of a plant grew through rotten plant pots directly into the balcony floor.

As a result, the building structure was affected. As a result, the tree was in danger of toppling over due to the lack of support. In addition, it could not be ruled out that passers-by would have been endangered by the tree.

Tree on the balcony – only after consultation with the landlord

But in general, tenants are well advised to talk to their landlords in advance about recommended plants. This recommendation applies especially if trees are to be placed on the balcony. The heavier a tree, the more the growth affects its statics. Under these circumstances, the balcony could collapse in the worst case scenario. Trees may also disturb neighbors, for example by impairing visibility.
