Mexico regrets Arizona court ruling in Gabriel Cuén case

The Ministry of Foreign Affairs (SRE) regretted the decision of the Superior Court of the county of Santa Cruz, Arizona, to decree the final dismissal (dismissal with prejudice) of the criminal case against the American citizen George Alan Kelly, accused of second-degree murder of Mexican Gabriel Cuén Buitimea, occurred on January 30, 2023, in Nogales, Arizona.

Despite the Santa Cruz County District Attorney’s Office filing a motion for dismissal or provisional filing of the process before the High Court, the judge of the case decided to reject the request on July 9, ending the procedure in relation to George Alan Kelly and inhibiting a new criminal prosecution against him for the same fact.

It is worth mentioning that, with the Court’s ruling, the possibility of retry to the American, denying the family of Gabriel Cuen the expected justice.

Meanwhile, the SRE through the Consulate General of Mexico in Nogales, respectfully urged the authorities of Santa Cruz County, Arizona, to continue the investigations and prevent the unfortunate murder of our fellow countryman from going unpunished.
