A three-day sexual assault trial in Dartmouth, Nova Scotia, ended before it truly began Thursday when Crown lawyers announced they would not submit any evidence against the Nova Scotia-based actor. Provincial court Judge Jill Hartlen dismissed the single count of sexual assault, closing a legal track that began in October 2025 when Smith was charged.
Outside the courthouse, Crown prosecutor Bryson McDonald told reporters that ongoing assessments led to the determination that the prosecution standard had not been met. McDonald declined to discuss specific facts or prosecutorial discretion, noting only that evaluations continue throughout every step of a proceeding based on incoming information and evidence.

Defence lawyer Stan MacDonald appeared on behalf of Smith, who did not attend the Thursday morning court session. Following the Crown’s announcement, the defence moved for a dismissal, which the judge granted. MacDonald told reporters outside the courtroom that his client was pleased to put the legal proceedings behind him.

Complainant Withdraws Testimony to Protect Mental Health
The decision to drop the case followed the complainant’s decision to withdraw from testifying. According to reporting from Canada’s public broadcaster, the unnamed complainant released a statement explaining that she was unwilling to sacrifice her mental health by recounting the incident publicly. The prosecution’s case hinged almost exclusively on her testimony.
In her statement, the complainant described the difficulties victims face when seeking justice through the legal system. She expressed frustration with defence tactics that she said blame victims for reporting crimes, adding that stepping away served as a way to reclaim her agency after examining options within an investigative apparatus that stripped her of her voice. A standard court-ordered publication ban protects her identity.
Trailer Park Boys Incorporated Welcomes Actor Back to Franchise Operations
With the legal matter concluded, Trailer Park Boys Incorporated issued a statement confirming that Smith would immediately resume his business and operational responsibilities with the organization. Smith had stepped away from his duties as a managing director and company director after his arrest in October 2025.
Trailer Park Boys Inc. is directed by Smith alongside co-stars John Paul Tremblay, who portrays Julian, and Robert Wells, who portrays Ricky. The Nova Scotia-based production company oversees the cult mockumentary franchise set in the fictional Sunnyvale Trailer Park, which follows the adventures of Bubbles, Julian, and Ricky running get-rich-quick schemes.

The franchise expanded after its debut on Canada’s Showcase channel in 2001 under creators including Barry Dunn, Wells, Tremblay, and Mike Clattenburg. The original series ran for seven seasons until 2008 before Netflix picked up the property in 2014, leading to multiple feature-length films, spinoff series, and holiday specials.
Smith Faced Similar Dropped Charges in 2016
The 2026 dismissal marks the second time Smith has faced criminal allegations that were subsequently dropped. In April 2016, Los Angeles authorities charged the actor with a misdemeanour domestic battery charge following an incident at a Hollywood hotel involving a female friend. The Los Angeles City attorney’s office dropped that charge a month later due to a lack of sufficient evidence, after Smith maintained his innocence through a written statement denying any assault occurred during a loud and heated dispute.
