Legislation resolving the issue of workers entitled to a disability pension who were previously required to stop working as a condition to receive it is being promoted by Ministry of Labor and Social Security.

Specifically, with a provision that was included in the draft law of the Ministry of Health entitled “Reformation of the institution of the Personal Physician – Establishment of University Health Centers and other provisions of the Ministry of Health” which has been put to public consultation, it is provided that the insured e-EFKA which are principally entitled pension due to disability from a common disease, in accordance with the conditions laid down by law, will no longer need to interrupt their work to become recipients of it.

This measure will apply retroactively, i.e. pension applications that have been submitted since January 1, 2024 and have been rejected due to no prior interruption of insurable employment, are submitted again within six months and their consequences go back to the time of submitting the original application.

This specific provision is in line with the current legislative framework already established by the Ministry of Labor and Social Security according to which, for those pensioners who choose to work, their pension is not cut by 30% as was the case before the implementation of the measure, but they pay a contribution in favor of e-EFKA.

According to the ministry, the specific measure has been widely accepted, as over 190,000 pensioners have, to date, declared their employment on the relevant platform.
