The Ministry of Internal Affairs, together with the Ministry of Justice and the Ministry of Transport, are working on the issue of legislative consolidation of administrative responsibility for exceeding the permissible average speed by drivers on long sections of roads, recorded using automatic road complexes, the Autonews portal reported, citing the Ministry of Justice.

Currently, the legislation does not provide for punishment for speeding on certain sections controlled by cameras, while fines for exceeding the average speed do not differ from “instant” violations. Due to the fact that the place of the violation is indicated in this case, not a specific place, but the entire section, in the absence of a clear rule in the Administrative Code, drivers can challenge the fines in court.

“Now there are requirements that the place where the offense was committed must be indicated, and the court does not like the mark that it happened somewhere within a radius of 20 km,” lawyer Dmitry Dugin commented on this practice to the portal.

The Association of Manufacturers and Operators of Recognition and Photo-Video Recording Systems “Oko” proposed to consolidate separate liability for exceeding the average speed last year. The association is confident that fixing speeding with the help of complexes significantly increases road safety, and bringing to administrative responsibility for violations established by these complexes is legitimate.
