The Ministry of Digital Development, Telecommunications and Mass Media has proposed using the State Services portal as a third party in the distribution of compensation for personal data leaks. Maksut Shadayev, the head of the Ministry of Digital Development, announced this at the plenary session of the Vedomosti telecom conference.

The issue of compensation for users whose data was in the public domain is being discussed in the context of a bill on turnover fines that will be awarded to IT companies that have leaked personal data. The bill is in the final stage of discussion and will soon be submitted to the State Duma, said Shadayev. “If the operator confirms the leak, he posts information about it, then a certain amount of time is given when the victims can apply through the State Services with an application for compensation,” Shadayev explained the mechanism of the law.

According to him, the amount of compensation can be determined by the operator itself and offered to users whose data has been leaked. “Accordingly, if two-thirds of those who applied for this compensation through the State Services portal confirm it, it is considered that a mitigating factor is applied for the operator who leaked personal data,” Shadayev noted. Based on this, there will be no relief fund for the victims, the minister added. According to him, such a design was discussed with all market participants, including telecom operators, Internet companies, etc.

Answering a question from Vedomosti, Shadayev added that compensation may not be expressed in money – these may be discounts on services, bonuses, etc. The main thing is that these conditions should be accepted by 2/3 of the owners of personal data that have been leaked. If they do not accept these conditions, then the reduction factor will not be applied to the company when determining the amount of the turnover fine for the leak, Shadayev noted.
