Minvu detects “change of criteria” in favor of Grupo Patio

According to Minister Carlos Montes himself, the investigation detected a “change in criteria to allow the delivery of Feasibility Reports for Construction (IFC) to Grupo Patio, during Sebastián Piñera’s second government.”

The Ministry of Housing and Urban Development (Minvu) concluded the administrative summary regarding the actions carried out by lawyer Luis Hermosilla before the then Felipe Ward to speed up the procedures that would allow the Grupo Patio builds a housing project in Lampa.

The investigation was conducted by the head of the Urban Development Division, Vicente Burgos, who analyzed the administrative acts of the Metropolitan Seremi, after a Ciper report alerted about the possible pressures that had been exerted on this organization for the delivery of IFC related to the real estate project Parque Capital Centro Industrial of Grupo Patio.

In this regard, Minister Montes said that “these are events that did not occur during this administration, but that have to do with the ministry. We believe that this is an institutional responsibility, that we all contribute to doing things as seriously as possible. Whatever emerges here, we will hand over to the Public Prosecutor’s Office at the appropriate time, in addition to the report and many other additional records, at least two folders full of documents. As a Ministry, we have already said that we are at the disposal of the Prosecutor’s Office for any queries that may arise, especially after this report,” he added.

According to the Minvu, the Seremi “refused to grant IFC between 2016 and 2018. Then, in mid-2019, it granted a partial acceptance without applying article 2.1.21 of the OGUC, exceptional rule when there are several land uses, in addition to allowing any productive activity. However, during 2021 a new change in criteria was made that allowed considering that in the use of ISAM 6 land, not only dangerous productive activity projects can be located (which is what the PRMS provides) but also harmless, which is key to the real estate value of each of the project’s lots.”

Vicente Burgos, head of the Urban Development Division of the MINVU, explained that, “in summary, there is a change in the criteria regarding the acceptance of the project. In a first stage, until 2018, where in some way the Seremi of Housing and Urbanism rejected the project. In any instance where its opinion was consulted, the truth is that it rejected it, until February 1, 2018. There was a second stage, where based on some claims made by Parque Capital, the project was partially accepted. And we say partially in the sense that certain articles that favored the management of the project were not applied and that allowed it to continue its course, but not with all the construction possibilities that this project expected. This process began in 2019, following a claim, and ended in 2021 with a new change in criteria in August 2021.”
