Seven years before voting for the decriminalization of marijuana possession for personal use, Minister Alexandre de Moraes, of the Federal Supreme Court (STF), was seen cutting off the drug’s stalks with a machete in Paraguay. The 2016 video went viral on social media after the minister’s vote on Wednesday’s trial (2).

Moraes, then Minister of Justice under former President Michel Temer, traveled to the neighboring country to work in a joint operation against transnational crime. At the time, he went so far as to say that one of the portfolio’s priorities was to fight criminals and “eradicate marijuana” in South America.

Judgment of the STF

The Supreme Court resumed, this Wednesday, the judgment that discusses the decriminalization of the possession of illicit drugs for personal use in the country. At the time, Moraes voted in favor of the release, but restricted the measure to marijuana only.

The minister also defended the establishment of a minimum amount of drug that the user can carry in order to differentiate him from a drug dealer. He suggested somewhere between 25 and 60 grams.

With Moraes’s vote, the score is now 4-0 in favor of decriminalization
possession and possession of drugs for personal use. The rapporteur of the case, Minister Gilmar Mendes, suggested that the trial be postponed once again, a request that was accepted by the President of the Court, Rosa Weber.

Before Moraes, ministers Luís Roberto Barroso, Edson Fachin and Gilmar Mendes had already positioned themselves against the criminalization of drugs for personal consumption.
