In reality, Autostrade and Spea also claimed that they could not be called into question, because – in the thesis of their lawyers – although the two companies had participated in the evidentiary incidents, they did so. only as defendants (based on the law on administrative liability of entities) and not as potential civil liable persons, a circumstance that would have infringed their right to defense. A thesis to which not even the public prosecution was opposed at the hearing – represented by the prosecutors Massimo Terrile and Walter Cotugno – but to which the gup has chosen not to adhere: otherwise, none of the public entities work of the 59 defendants would have been called to pay damages. The hearing was postponed to next September 28, when the prosecutors’ conclusions will begin.
