Jabalpur: The Madhya Pradesh High Court has issued a notice to the state government and the Jabalpur Collector in response to a petition challenging the collector’s order related to not transferring a piece of land acquired under the MP Ceiling Act back to the owner’s name even after the Act was repealed.

Petitioner Munnalal Patel said that the land taken from him under the Ceiling Act was not being transferred to his name even after the Act was repealed.
His counsel Dinesh Upadhyay argued that under Section 4 of the Urban Ceiling Act, 1999, if a case related to land acquisition under the Act is pending in court, the land will be returned to its owner if the sealing process is cancelled. The petitioner’s appeal against the acquisition of his land was pending in the divisional commissioner’s court, which became useless after the ceiling act was repealed in April 2000.

Following this, the petitioner applied before the competent authority—District Collector Jabalpur—and sought his land back. The collector rejected the application saying that the state government has taken possession of the land in question. Upadhyay said that the land is still in the possession of the petitioner and the order of the District Collector Jabalpur is in violation of the provisions of the Sealing Act.

After preliminary arguments, a bench of Justice Vishal Dhagat issued notice to the respondents in the case—the Madhya Pradesh government and Collector Jabalpur.
