The National Assembly validated on Friday September 29 a new principle of suspension of RSA rights in the event of a breach, the beneficiary being able to then recover at least part of the lost sum, a more gradual sanction affirms the executive, a ” shame “ denounces the left.
The “suspension-remobilization”
When considering the bill ” full employment “the deputies adopted an article establishing this “suspension-remobilization”as the presidential camp calls it.
If a beneficiary does not prepare a “reciprocal engagement contract” or does not respect part of its obligations, the departmental council (or France Travail if the department delegates this competence to it) may decide to suspend the payment of its RSA.
If the beneficiary complies with his obligations, he could however retroactively recover the lost sums. But he could only recover a maximum of three months of RSA payment, a ceiling added against the advice of the government during the examination of the bill in the Senate, but which it ultimately accepted.
A sanction presented as more gradual
There is already a sanction today “which consists of cutting the RSA of a household”but in practice “this part is never returned”affirmed the Minister of Labor Olivier Dussopt, defending the new system as a more gradual sanction than suspension without retroactive payment or pure and simple cancellation.
Far from being convinced, the left criticized at length an article by ” shame “with sanctions whose number risks skyrocketing, while article 2 of the bill creates an activity obligation of 15 hours per week, with exceptions.
“Everything shows that the sanction leads to the street and the exit from the system, it is factual”insisted the socialist deputy Arthur Delaporte.
For the president of the LFI group, Mathilde Panot, the measure goes against the International Convention on the Rights of the Child, which provides that signatory states must protect the child. “against all forms of discrimination or sanction motivated by the legal situation (or) the activities (…) of his parents”.
The RN abstained
The article was adopted by 38 votes to 30 with the support of the majority and the LRs. The left and the Liot group voted against. The RN abstained.
In the middle of the afternoon, the deputies also adopted the following article, which creates a “network of integration and employment actors”with the aim of improving support for job seekers.
It will bring together the State, local authorities, Pôle emploi which will take the name “France Travail”but also local missions, business representatives, certain integration establishments, etc.
A national committee, chaired by the minister, would be responsible for coordinating its action and defining the “strategic directions”.
But the left sees it “put under guardianship” of the State, according to Arthur Delaporte, and “a gas factory”according to LFI deputy Hadrien Clouet. “You will make all the professionals who will work in these settings unsafe”he criticized.
