Multi-competent justice – El Comercio

Justice is as important as life and freedom for being inescapable and inseparable from the truth. It has been defined as “the moral principle that inclines to act and judge respecting the truth and giving each one what corresponds to him”.

From ancient Greece, and before, in the famous Hammurabi’s Code -considered the first penal and civil code of humanity-, justice has been the object of study and since then governs all the laws of the world.

The classical definition of justice came from Aristotle, who is credited with the idea of ​​”giving each his own.” The Greeks understood it as a resource to balance loads. And these “burdens” have not been easy, because in detriment of justice Subterfuges have been invented to install opposing systems, such as injustice and its substitutes: moral and economic poverty, generally manipulated by power.

These concepts are affirmed when we feel the orphanhood that we Ecuadorians suffer in front of single courts, criminal or multi-competent guarantees -created by the Judiciary Council, Resolution No. 031-2011-, “so that they know competence in all matters in the first instance”-.

It is embarrassing to record the abuse of these guarantees: criminals -with final sentences for crimes classified as serious- are released, to the detriment of the legal certainty of the Statethrough tricks of various kinds: habeas corpus, reductions in unjustified sentences, requests for pre-release, probation, substitute measures, medical reports and transfers to hospitals, decisions in telematic hearings, dismissals and revocations of preventive detention, among others.

Faced with the degradation of justice -and in cases its prostitution-, there is no room for codes of ethics, only radical changes. That trust be returned to society -in the respective jurisdiction and competence- and that justice with autonomy “In the name of the sovereign people of Ecuador, and for authority of the Constitution and Laws of the Republic”.
