New setback for Garcia with impeachment proceedings against him

The dispute between the Congress of Nuevo Leon and the state governor, Samuel Garciatook a new turn, because the Anti-Corruption Commission unanimously approved the origin of the impeachment against the president for allegedly violating the constitution and other laws.

In the document presented by the legislators, they accuse the state Executive of failing to comply with at least 18 articles of the Constitution, as well as five articles of secondary laws, seven resolutions of the Supreme Court of Justice of the Nation and three resolutions of the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation.

After the formal initiation of the process, García must be informed either in writing or in person no later than Thursday, August 22 at 4:00 p.m. so that he can name his defense.

“Impeachment proceedings against Mr. Saml Alejandro Sepúlveda, head of the Executive Branch of the State of Nuevo León. The Chief Clerk is instructed to summon the accused through the Legal Department of Congress to inform this Commission of what is in his interest, forwarding copies of the complaint and the other documents that comprise it, and indicating the following dates and times for his respective report. The accused are requested to inform, if applicable, the name of his defense attorney or whether he will require one to be appointed. State Public Defender’s Institute (sic.)”, part of the agreement states.

However, as of press time, the governor has not issued an official statement on the start of the impeachment trial, although he is expected to present his defense in the coming days, as established by the procedure.

In recent days, Congressman Jessica Martínez pointed out the importance of immediately resuming the impeachment procedure previously initiated, in order to determine the political responsibility of the Governor for not presenting the budget of the State Government for the 2023 fiscal year.

It is worth noting that at the beginning of June, the Supreme Court of Justice of the Nation (SCJN) halted the impeachment of García Sepúlveda, but yesterday it was voted on and reactivated.
