Newborn Injuries Due to Delayed Birth, Gynecologist Sentenced – Health & Wellness

(ANSA) – ROME, JULY 4 – A gynecologist at the Santa Scolastica hospital in Cassino has been sentenced to 6 months by the Court of Cassino for the delay in performing a cesarean section on a patient, thus causing serious neurological damage to the newborn. The sentence came at the end of an eight-year legal battle between the two young parents.
The facts date back to November 4, 2016 when the couple went to the hospital: the young mother was in her 41st week of gestation and suffering from very strong abdominal pain.
Despite the diagnosis at the beginning of labor, she was discharged, only to be hospitalized and operated on two days later for a very serious fetal distress with disappearance of the heartbeat. The baby was then born a few hours later, with very serious neurological damage, which determined his emergency transport to Bambin Gesù. There, the doctors hypothesized that the delay in carrying out the delivery had caused those consequences.
The parents filed a complaint but the Prosecutor’s Office requested the case be closed. The couple opposed the case through lawyers Paolo Marandola and Benedetta Altobelli and the Gup, accepting their requests, ordered the forced indictment of 5 doctors from Santa Scolastica. From the trial, which lasted 4 years, it has now emerged that the caesarean should have taken place within 30 minutes of the second hospitalization at the latest and that that delay was a determining factor for the very serious pathologies from which the child is still suffering. For this reason, Judge Marco Gioia today sentenced the gynecologist to six months in prison (suspended sentence) and to pay compensation for any damages suffered by the child. The other four doctors were acquitted. (ANSA).
