“We reserve the right to appeal with an amparo in the Court, which has already intervened in other provinces and could do so in CABA,” said Artaza, enthusiastic about the rulings of the highest court that suspended the elections in Tucumán and San Juan on suspicion of that two applicants (Juan Manzur and Sergio Uñac) did not meet the requirements to compete. In that case, because their reelection would not be authorized by the provincial constitutions; In the case of Macri, the problem is that -according to Artaza- he would not have the address required by law to appear in the city.
The actor and former senator, who announced that he will also seek to compete for the head of government, stated: “This is not out of animosity against Jorge Macri, but if one is going to govern, the first thing is to comply with the constitution of the place where he is going to govern.”
Last month, in statements to Telam Radio, Artaza had said about his party, Cambio Popular: “Our limit is Macri and the extreme right of the libertarians. Then we call on everyone to contribute ideas and hopefully we can influence to improve the quality of life of the people of CABA”.

“My need to clear up the uncertainty to which the public is subjected, lies in the journalistic versions, television interviews (and the statements of former President Mauricio Macri) that would indicate that Mr. Jorge Macri, an official born in another jurisdiction, who is in the exercise of an elective position in the province of Buenos Aires -mayor of Vicente López-, and who does not have an address in CABA, could present himself in the next primary and general elections for the category of Head of Government of this City, in flagrante violation of the current Electoral Law”, Artaza wrote in his presentation this Thursday.
The actor and former senator said that he understood that “the time to challenge candidacies is appropriate when they have been formally presented”, something that did not happen in this case, but that “the notoriety that the candidacy of Mr. Jorge Macri and his his own statements before the media” forced him to request the intervention of the electoral justice to clear up “the state of uncertainty that could cause injury to all the citizens of CABA”.
Artaza recalled that the Constitution of the Autonomous City of Buenos Aires provides, among other exclusive requirements, “to be a native of the City or to have a habitual and permanent residence of not less than five years prior to the date of the election.”
“This situation is far from reflecting reality,” he said, “since at the end of 2021 Mr. Jorge Macri would have requested a temporary license in the Vicente López Party, place of residence and permanent work activity. But even more so, the aforementioned necessarily had to vote in 2019 in the Province of Buenos Aires. Well, how could he be an elector or aspire to an elective position in CABA, then four years later, when the CABA Constitution explicitly provides for five?
Artaza accused Jorge Macri of “contempt for the Institutions” which, according to the letter presented this Thursday, “would also be evident in the fact that he had not even formalized a resignation from the position for which he was legitimately voted.”

In article 97, the Buenos Aires Constitution establishes that whoever is not a native needs habitual and permanent residence for at least five years. To be a candidate for mayor of a Buenos Aires municipality, the Provincial Constitution orders that one must be a “neighbor of the district with one year of domicile prior to the election.”
In Vicente López, Jorge Macri’s home is in La Lucila. “Since she lives with me, she has made this apartment a home,” he told Hola magazine in December 2021, referring to his wife, Belén Ludueña, and their house in La Lucila, almost a year before they got married. As they told THE NATION near the candidate, he used that property again to pass the quarantine, but he had left it “much before” as his usual residence and lives in Palermo.
Consulted about the overlapping of addresses, to compete in the Capital and having done so before in Vicente López, from the pre-candidate’s environment they affirmed that, “to be mayor of a town, the law establishes that it is enough to have an address, residence is not necessary ‘usually and permanently’ in the district, as required by law in the city”.
