How will the new Cadastre work if and when the reform goes through? The surface of the residential properties will no longer be expressed in cadastral rooms but in square meters. Finally, the definition and classification of properties will change, divided between ordinary and special.

What changes

Whenever there was talk of land registry reform, it was done with the premise that it would take place with equal tax revenue. So again this time, with the addition that if there will be an increase in revenue, it will be obtained by tracking down the properties unknown to the tax authorities (they would be 1.2 million) and recovering tax evasion on Imu and lease taxes. But the invariance on who is surveyed today and pays regularly appears rather complicated to achieve. There is no doubt that the rates of the Imu will have to be revised downwards: at current levels (0.76% the reference rate, 1.14% the maximum) would lead to a stratospheric increase in taxes. It is clear that there would be a shuffling of cards and that there would be those who would end up paying more and those less.


It remains to be seen whether revenue invariance should be considered at national or municipal level. Not a small difference, because there are municipalities in which the gap between the Imu taxable amount and market value is very limited and others that record a very high gap between the market and the tax authorities. Invariance at the municipal level would mean perpetuating a situation of inequity, invariance at the national level would instead entail that in some municipalities the taxes are destined to rise a lot, causing inevitable protests and that in other municipalities they will decrease, with the Treasury having to compensate the remaining municipal coffers dry. Once the new values ​​have been assigned, many owners could file opposition by opening a dispute that would flood the offices.

The first house: no taxes but …

In the end, iPrime Minister Mario Draghi reaffirmed that there is no intention to introduce taxes on first houses, but the revision of the estimates (the real estate revenues calculated by the land registry for tax purposes) could lead to a substantial revision of the number of exempt taxpayers. With the current rules they do not pay the lmu and pay reduced taxes (2% instead of 9%, 4% instead of 22% in the VAT regime), in the event of a purchase that meets certain requirements of possession and residence, all the houses that do not belong to the cadastral categories A / 1, A / 8 and A / 9, the three groups that identify luxury residences. The change in classification will lead to a change in the definition of luxury property and to include many more houses than the current ones.
