On Tuesday, July 17, 2024, President Daniel Noboa promulgated Executive Decree 334, following the request of the Ministry of Defense of Ecuador. This action eliminates two provisions of the General Regulations of the Organic Law of National Defense, issued on July 11.
The deleted sections, Article 24 and Article 25, stipulated that the National Police would act as an auxiliary force of the Armed Forces during a state of exception or emergency and would be partially or totally subordinated to the Joint Command of the Armed Forces, according to Articles 64 and 65 of the Organic Law of National Defense.
With the elimination of these provisions, police officers will no longer function as an auxiliary force or be subordinate to military commanders during states of emergency. Currently, a state of emergency, in force since July 2, 2024, affects the provinces of Guayas, Los Ríos, Manabí, Orellana, Santa Elena, El Oro and the canton of Camilo Ponce.
