Chennai: The Madras High Court has ruled that non-payment of rent and non-renewal of contract is illegal.

There is a Petrol-Diesel outlet of Bharat Petroleum Company in Hosur, Krishnagiri District. The land on which this station is located was purchased by Dr. Chitra in 2012.

Investigation

He filed a case in the Madras High Court seeking an order to vacate the premises.

The case came up for hearing before Justice N. Satishkumar.

At that time, the lawyer appearing for the petitioner said, ‘The contract made by the company with the seller of the land ended in 1998. Then, the contract is not renewed; No rent is paid; The license has also been cancelled. He argued that the company should be ordered to hand over the vacant land.

The lawyer appearing for the company said, ‘Though the contract has not been renewed, we are paying the rent properly.

Accusation

“Before purchasing the land, the petitioner did not inform. Allegation also arises that the land belongs to the Waqf Board. Therefore, vacation of this land cannot be demanded’, it was argued.

After arguments from both sides, the judge passed the order:

Although the company claims to be paying rent for the land, it has not filed a single piece of paper to prove it.

From 1964 to 1998, the company enjoyed the land by paying a small rent.

Notice

The respondent cannot claim that they were not informed before the property was sold to a third party. Deed of property is a kind of notification notice.

When no proof of payment of rent is filed, it means that the company is encroaching on the property and occupying the land.

If the agreement is not renewed after 1998, the land cannot be enjoyed continuously.

Trespass

It is not possible to accept the contention of the respondent that the land belongs to the Wakpu Board during the argument without saying anything in the reply.

It is illegal to stay on leased land without paying rent or renewing the contract; It means trespassing.

Therefore, the company should hand over the property to the petitioner within two months.
