Nursing home in Lower Austria – penalties in the case of a new trial increased further

In the new trial for the cause of the nursing home in Kirchstetten (district of St. Pölten) at the regional court in St. Pölten, the penalties for three of the four originally accused were increased on Thursday. Former workers at the facility were sentenced to between 18 months and three and a half years in prison.

After the Supreme Court (OGH) partially overturned the three guilty verdicts of 2021, only the findings that were already final were dealt with in court. They will be dealt with further at a later date. Thursday’s recent rulings are not final. “Inconsiderate and Deeply Despicable” The presiding judge described the actions as “reckless, particularly despicable and deeply despicable.” The accused – two men and one woman – not only committed the crimes, but also “made themselves ridiculous” about those affected. The quartet originally accused was sentenced in February 2021 to conditional prison sentences of twelve to 18 months, two people received also fines. The Vienna Higher Regional Court increased the sentence of the fourth defendant from one year conditionally to two years unconditionally in May. This case was no longer part of the proceedings.
