Chennai: The Madras High Court has banned the finalization of the tender for bringing coal from Odisha.

In the petition filed by Tirupur-based ‘ACS, Marine Services’, the Andhra Company’s tender for bringing coal from Odisha to Chennai had been violated and it had sought an order to invalidate the tender.

This petition came up for hearing before Justice R. Suresh Kumar. Advocate V. Lakshmi Narayanan appeared on behalf of the petitioner, Special Pleader Edwin Prabhakar on behalf of Boombukar Kapal Kazhagam and Additional Pleader B. Vijay appeared on behalf of the Government.

Justice Suresh Kumar passed the order:

This is a tender for bringing coal from Bharathip Port in Odisha to Ennuar Port.

It has been stated by the petitioner that instead of a cargo ship with a high tonnage capacity, a ship with a low tonnage capacity was inspected by ‘Sharath Chatterjee’ company from Andhra Pradesh, and it was accepted by Bhoompur Corporation.

It was also requested to cancel the tender as this was not acceptable as per the conditions.

Further investigation is required to make a final decision in this case. As coal is essential for power generation, I will hear this case in 2018.

Meanwhile, the tender for the Andhra company should not be finalised. The status quo must continue. In other words, the work of taking further coal should not be entrusted to the Andhra Company.

This is what the judge has ordered.
