“Control Immigration” et “improve integration”. The text composed of twenty-seven articles, which The world was able to consult, and whose balance the executive praises, intends to facilitate the regularization of undocumented workers while strengthening the possibilities of expulsion, in particular of delinquent foreigners. The bill also addresses the simplification of litigation for foreigners or the acceleration of the processing of asylum applications. It also provides for making obtaining a multi-year residence permit conditional on mastering a minimum level of French (to be determined by decree), making it possible to take coercive fingerprints, tightening the residence condition for the renewal of long-term permits or to prohibit the administrative detention of minors under 16 years of age.

This text has so far neither the support of the right nor that of the left. The first criticizes the project for its section on the regularization of undocumented workers, the second denounces yet another repressive law. What leave uncertainty on the parliamentary majority that will be able to release Renaissance. In an interview at ParisianSaturday, January 28, the Minister of the Interior, Gérald Darmanin, once again extended his hand to the Republicans, saying he was ready to discuss “quotas to limit adjustments” during the examination of the text, which must begin in mid-March in the Senate.

Facilitate adjustments

As it stands, the text’s main audacity therefore consists in tackling the sensitive issue of undocumented workers. In a context of strong growth in labor immigration (+ 45% in 2022), driven by the needs of the economy, the government proposes to facilitate the regularization of undocumented workers already present in the territory. Their fate is now subject to the discretionary power of the prefectures, which apply the criteria set out in the 2012 ministerial circular, known as “Circular Valls”. To qualify for a residence permit, a worker must, for example, present proof of a minimum of three years of presence in France, at least twenty-four pay slips and a promise of employment from his employer.
