One-Sex Marriage Recognition Petitions Transferred to Supreme Court Hearing | Change of same-sex marriage recognition petitions to Supreme Court hearing

NEW DELHI: The Supreme Court has consolidated the petitions pending in various High Courts seeking legal recognition of same-sex marriage.

The demand for legal recognition of same-sex marriage has been going strong for years.

Two same-sex couples filed a petition in the Supreme Court in November last year, seeking the right to register same-sex marriages under the Special Marriage Act.

Similarly, two petitions were filed in the Supreme Court last month seeking to transfer two petitions filed in the New Delhi High Court seeking legal recognition of same-sex marriage to the Supreme Court.

In this case, the Supreme Court heard these petitions and ordered the central government to file a reply in this regard.

These petitions came up for hearing again.

At that time, Solicitor General Tushar Mehta, appearing for the central government, said, “There are only two possibilities in this matter. These petitions are coming up for hearing in the New Delhi High Court.

“We can wait for its verdict or the Supreme Court can transfer all the petitions related to this matter to them,” he said.

The petitioners also requested that the Supreme Court transfer all the petitions for trial.

Following this, the Supreme Court yesterday ordered to transfer the petitions filed in various courts across the country seeking legal recognition of same-sex marriage.

The judges advised that not a single petition should be left out and those who are unable to participate directly in the case should participate through ‘online’.

The court ordered that the case will be taken up for hearing in March.
