Alimony is a legal right of a woman

Supreme Court senior advocate Rekha Agarwal says that even in ordinary divorce cases, when the matter of maintenance and alimony comes up, similar things are said that she robbed so much money. The only reason for marriage was that she left him penniless. Whereas, this should not happen at all, because it is her legal right. In both Hindu Marriage Act and Special Marriage Act, the law has given the right to maintenance in case of separation and alimony after divorce, but it is not that the girl will get whatever she asks for. For that, both the boy and the girl have to declare their movable and immovable property and income. The court decides alimony and maintenance on the basis of all these parameters – the boy’s property, income, who all are dependent on him, if he has a child, with whom is he living. It is not that after divorce the wife will automatically take away 50%. Another important thing here is that there are two types of divorce. The first one is mutual, in which both the parties decide everything by mutual consent. Whereas, the second one is fought in the court. In the case which is fought, the court hears the claims of both the parties and decides the alimony or alimony on the basis of their movable and immovable property. Whereas, in mutual the court has no role at all. In that, if the girl wants, she may not take even a single rupee as alimony or if the boy wants, he can transfer everything to her name.

Women keep dragging their heels

Regarding alimony cases of common people, Rekha Agarwal says, ‘These rights in the law have been made very thoughtfully and after careful scrutiny. There are many different provisions in them. For example, the allowances or alimony of these celebrities are higher because according to the Supreme Court, the girl has the right to live the same life that she was living in her husband’s house even after divorce. On the other hand, if she earns on her own and is settled, then her alimony is reduced. By the way, in common cases, apart from celebrities, most women have to struggle a lot to get alimony. Court cases go on for years. Then, tired and tired, women settle for half of the alimony they demand. On top of that, if the couple has a daughter, then the father is not ready to take her. In most cases, the mother takes her custody. Even if the child is less than five years old, the mother gets her custody. Just imagine, if in such a situation the woman does not get any allowance or alimony then how complicated her future life will become.

Men also get alimony

Although alimony is generally given to the wife, but in some circumstances the husband can also demand alimony. Such a situation arises when the wife’s income is more and the husband’s income is less or the husband is unemployed. Then the husband has to give an affidavit in the court to prove that his wife earns more than him or she is financially incapable.

In foreign countries everything is divided in half

Amidst the news of Natasha being given 70% of Hardik’s property as alimony, an old video of Hardik is also going viral, in which he is telling that he has named all his property in his mother’s name, so that in future he does not have to give 50% share to his wife (in case of divorce). But Rekha says, it is not written anywhere in our law that the girl will take 50% of the property. It happens in America that in case of divorce, the property of both husband and wife is automatically divided in half. If reports are to be believed, this trend has also been seen in the US that women there are richer than men despite less salary, due to the alimony received from divorce.
