Order to pay wages and benefits to illegally dismissed employee in Saudi Arabia

Riyadh: The labor court ruled in favor of the worker’s complaint against his unfair dismissal from the company he worked for in Saudi Arabia. The Riyadh Labor Court ordered that the complainant be paid the salary, experience certificate and retirement benefits. Company representatives did not participate in any of the court proceedings.

The court has ruled that the verdict is final and the company cannot appeal against it. The employee was dismissed on the grounds that a branch of the company he was working for was closed down. But the retirement benefits were denied. In the complaint, he alleged that the salary was arrears and the work experience certificate was not given. The letter issued by the company’s HR department informing about the dismissal was presented to the court as evidence. The complaint sought statutory damages including two months’ salary for unfair dismissal.

The court asked the company for an explanation on the complaint, but it did not respond. Notification through special online portal was not considered. After receiving no response from the company, the court asked the complainant to file an affidavit under Shariah law stating that all his claims are true. After receiving this, the verdict was pronounced in his favor.

The court ordered to pay the due salary, statutory retirement benefits and two months salary in lieu of illegal dismissal. Apart from this, work experience certificate should also be provided. The court ruled that no money should be paid for it and that the certificate should not contain any mentions that would be detrimental to the complainant.
