A little over a year ago, José Orellana was sentenced to 3 years in suspended prison and perpetual disqualification from holding public office for the crime of sexual abuse.
The former mayor of the Tucumán town of Famaillá was accused of having sexually attacked Agustina Poch, who worked as an advisor to former deputy Gabriela Troaino in the National Congress.
However, until now the sentence was not final and in the midst of this judicial limbo the official was chosen to be a representative on the Advisory Council of the Judiciary of Tucumán (CAM).

“The first item on the Agenda was the incorporation of Mr. Carlos Francisco Gómez as Provincial Legislator, replacing Mrs. Legislator Gladys Medina. Subsequently, the Parliamentarians who will represent the Honorable Legislature in the Advisory Council of the Judiciary were elected. The titular Legislators will be Orellana, José Fernando; Chustek, Roberto Osiris; and Courel Manuel. The substitutes will be Leito Mario; Assan Sara; and Berarducci Walter,” says the details of the December 14 ordinary session of the Tucumán Legislature published on the official website.
After learning of the former deputy’s appointment, Poch questioned the institution and noted: “It seems aberrant to me that, days after the end of the trial that found him guilty of sexual abuse, days after the completion of the trial, José Orellana assumes the position of member of the CAM for the Legislature.” In addition, he also took over as President of the Municipal and Community Affairs Commission.
“The exposure and constant revictimization suffered within a judicial process of more than 6 years seems to be not enough when it comes to appointing authorities,” he noted in dialogue with TN.

The official site of the CAM indicates that the organization “arises as a response to the desire of the Tucumán community to have a Justice of excellence.” In response to this, the complainant stated: “That is why it is paradoxical that they ignore the judicial situation in which Orellana finds himself.”
Along these lines, he emphasized: “It is hard to believe that the Advisory Council of the Judiciary, which is a body that participates in the selection and removal of magistrates and officials of the Judicial Branch of Tucumán, consents to having a person who has a conviction for which we are, today, awaiting the final sentence.”

The reported episode occurred during midday on November 11, 2016. At first, the victim appeared in the media with a pseudonym and then decided to make her identity known, a situation that she took advantage of to tell in first person what she experienced. .
The girl said that that day she received a call from the security area, in which they informed her that they could not contact Orellana’s office. The reason is that there were people who wanted to see him and needed him to respond. That is why Poch entered the mayor’s office.
Once inside, the politician began to go too far. Not only did he grab her hands and make inappropriate comments, but he also brought her body closer to his and had non-consensual attitudes. “Surely no one kissed you like that, right?” she said he told her as he lunged at her.

Poch came out scared and quickly took in the dimension of what had happened; That’s why she went to the official Gabriela Troiano to tell her everything.
The accused, days later, sent messages to the victim and asked her not to make the report because that could cause problems. “The only thing I ask of you, if it is true that there is a complaint, that you do not harm me because I have a family and in my position it complicates everything. Thank you from the bottom of my heart,” the WhatsApp message said.
However, the complaint did not complicate it: Orellana ended his term as national deputy for Tucumán of the former Front for Victory – despite the projects presented to suspend him. Even he always denied the facts and maintained that it was a “political operation.” In 2019 he was elected in the local elections as mayor of Famaillá.

Agustina suffered from working in the same place as her abuser. For months she made all kinds of maneuvers to avoid crossing him until they stopped sharing a building.
Although it had been dismissed in the first instance, the National Court of Criminal and Correctional Appeals ordered the prosecution of Orellana in 2020, considering him “the author criminally responsible for the crime of sexual abuse.” Then they convicted him.
