The President of the Senate, Rodrigo Pacheco (PSD-MG), stated this Thursday, the 14th, that party leaders agreed to present a Proposed Amendment to the Constitution (PEC) to classify the possession and possession of any drugs considered illegal as a crime.
Pacheco’s announcement came after the meeting of party leaders in the Senate. He reinforced the need for the issue to be addressed exclusively by the Legislative Branch. The declaration comes amid the possibility of decriminalizing the possession of some types of drugs, such as marijuana, enter the agenda of the Federal Supreme Court.

“The understanding of the Federal Senate is that we must legislate”, reinforced Pacheco. “A first path to be observed is a PEC that says that it should be considered a crime to possess or possess a narcotic and illicit substance under any circumstances in any quantity.”

According to the president of the Senate, the deliberation was made by the majority in the college of leaders. Now, the proposal will proceed to collect signatures.
Pacheco suggests speeding up the proposal against drug decriminalization
According to Pacheco, the text must be presented by Friday the 15th. Afterwards, it will be necessary to start collecting support. For the proposal to be filed for processing, it is necessary to have at least 27 signatures.
The PEC is a contrary response to the discussion taking place in the STF, which intends to decriminalize the possession of marijuana for personal consumption. So far, there are five votes in favor of decriminalization against one. The vote was interrupted on August 25, after a request for a review (more time to analyze the case) from minister André Mendonça. The deadline is 90 days for the return.
