Parents of those who died in accidents with a report to the prosecutor’s office against the judge who did not take away Noisey’s car

The parents of the children and young people who died in accidents, united in the “Angels on the Road” foundation, filed a report with the prosecutor’s office against the judge who did not impound Ivaylo Tsvetkov-Noyzi’s car.

A day ago, the reasons of Judge Miroslav Petrov of the Sofia District Court for Noyzi’s sentence were published.

For driving with a blood alcohol level of 2.5, Noisy received 10 months probation and a year and two months without a license. Judge Miroslav Petrov, however, pointed out that the confiscation of the car contradicts the basic law and the Charter of Rights of EU citizens. He also noted that the text of confiscation from the cars of drunk and drugged persons, who, however, did not cause another crime, was imperative and did not give the court any discretion.

“The confiscation of the car will completely unjustifiably affect the right to property of the convicted person and would in no way contribute to ensuring the required balance with the right to life and bodily integrity of the citizens, considering that it will make him a scapegoat for the edification of others members of society without a real contribution to raising the level of the permanently undervalued transport
safety in the country,” the judge stated in his reasons.

“Do the Bulgarian judges realize that thanks to such outrageous decrees, some of these road criminals become road recidivists and road killers? Road killers like those who killed our sons and daughters, our brothers and sisters, our grandchildren! And who will continue to kill! Other sons and daughters, brothers and sisters, grandchildren!, say from “Angels on the Road”.

They also add that “Bulgarian judges once again deserved contempt and strengthened the conviction in
Bulgarian society for being conscious accomplices in road traumatism and road murders in Bulgaria!”

In their report, the parents of the dead children refer to a text from the Penal Code, which states that “an authority that does not promptly fulfill the duties imposed on it
the service regarding criminal prosecution, or otherwise frustrates such prosecution in order to save another from the punishment due to him by law, shall be punished by imprisonment from one to six years”.
