PDP Law Transition Process, Experts Remind Mitigation of Personal Data Protection Failures

JAKARTA – The draft Government Regulation on Implementing Regulations for Personal Data Protection (RPP PDP) is still in the process of being discussed by the government. This follows the passing of Law Number 27 of 2022 concerning Personal Data Protection (UU PDP).

The RPP PDP is a guide for creating a more reliable personal data protection ecosystem and its application can cover all parties, both personal data controllers and data processors in the government and private sectors.

This view was conveyed by Bhredipta Socarana, Expert Staff for the Director General of Technology and Information at the Ministry of Communication and Information in a seminar with the theme Data Breach Management – Personal Data Protection and Data Leak Crisis Management in Jakarta, Wednesday 27 September 2023.

“The RPP PDP is still in the process of being discussed. In essence, the regulation of the PDP Law and PP PDP aims to anticipate the risks of processing personal data, not to punish personal data controllers or processors, or increase state income,” said Bhredipta Socarana in his statement, Thursday (28/9 /2023).

Apart from that, he said, the regulation of the PDP Law and PP PDP aims to develop the ecosystem. In this case, the Personal Data Protection ecosystem is still being developed, and requires contributions from all relevant stakeholders.

“So if there are requirements and input, we can continue to carry out hearings or written input to the Ministry of Communication and Information. Especially if there are questions about why there are so many articles, up to 245 articles, which actually provides an opportunity for more specific regulations for Ministries/Institutions,” said Bhredipta.

Meanwhile, according to Bhredipta, practical considerations, PP PDP strengthens the implementation of personal data protection principles in personal data processing activities for harmonious personal data protection governance.

Also consider the risks of personal data processing by the personal data controller according to the scope of personal data processing activities carried out. Another thing, through PP PDP will provide balance in regulating the relationship between data subjects, controllers and processors.

“This includes the obligation to provide information regarding the processing of personal data. Balancing the positions of data subjects and data controllers through regulating the obligation to request consent and the right to object to processing under certain conditions,” he said.

“We also take into account the conditions of access to knowledge related to PDP and its potential impact in understanding PP PDP in Indonesia,” he concluded.
