The supplement for gender gap is not taken into account in the application of the maximum limit of contributory pensions

In the same way that there is a minimum pension, the public system also has a maximum established. This year it is located at 39,474 euros per year paid in 14 payments of 2,819 euros each, which next year could be above 3,000 if the revaluation of 8.5% estimated by the Government is confirmed. That is the limit that, regardless of what we have quoted, we can charge except with one exception; if we exceed it by receiving the gender gap supplement.

This supplement has been delivered since last year to replace the maternity supplement created by the Government of Mariano Rajoy in 2016 for women with two or more children, which was declared discriminatory in 2019 by the Court of Justice of the European Union. Since then, different rulings recognized several parents the right to receive this bonus, for which the Ministry was forced to find another formula that would continue to provide a plus to women who have seen their contribution career affected by the birth. and care of the children and from which men with contribution gaps for this same reason could also benefit.

The formula finally chosen was the establishment of a fixed amount of 28 euros in each of the fourteen payments per child (up to a maximum of four descendants) that will be accessible to one of the parents, be it the mother or the father, provided that they comply with the established requirements. The supplement, as explained by Social Security, “is not taken into account in the application of the maximum limit of contributory pensions or to determine the supplement for pensions below the minimum.”

This means that, regardless of the retirement pension that is received and even if it is the maximum, the supplement is always established between 392 and 1,568 euros per year during the first year, an amount that is later revalued annually as well as the pension itself. pension. Thus, from the year of retirement, the beneficiary receives at least 28 euros more in each of the fourteen payments if they only have one child; 56 if he has two; 84 if there are three; and 112 euros if you have had four or more offspring.
