However, during its operation, the Tuynel brick factory was outdated, with old technology affecting the environment, and was stopped by the functional forces of Bac Ninh province.

According to people, in 2017, Tran Son Company converted the land use purpose from the Tuynel brick factory to a residential project for sale. The conversion does not have the consent of the land tenants and is contrary to the original land lease agreements.

Ms. Doan Thi Linh (63 years old, Phuong Trien village) said that her family had about 1.9 sao of northern land for rent to Tran Son Company for a price of about 69 million VND/sao at that time. Households rent to the company to build a Tuynel brick factory, create jobs and contribute to the local economy, rather than rent out land for them to turn into residential land and then subdivide and sell the ground.

“When the company converted from a brick factory to a housing project, they did not consult the people. After 50 years of the end of the land lease contract, will we lose our land?”, asked Ms. Linh.

According to Mr. Tran Van Cham (SN 1959, who had land for Tran Son Company to rent), when signing the minutes of the land lease agreement, people were asked by the local government to return the minutes of the agreement for the business to keep. Tran Son Company leases rice land to build a Tuynel brick factory, which is highly supported by the people for creating jobs for local workers. However, converting the land use purpose into a housing project to build villas, subdivision plots for sale, is not possible.

Ms. Nguyen Thi Luan (60 years old, Phuong Trien village) shared, her family has 1.5 sao of land for rent to Tran Son Company. The family did not agree that the company converted production land into a housing project without meeting to consult, as well as compensate the households.

“Now they build houses, divide plots on which to sell each m2 tens of millions of dong, while our people have lost their land and have no jobs,” explained Ms. Luan.

According to people, after people leased the land and filed a complaint, the Inspector of Bac Ninh province got involved, but after nearly 2 years, so far, there has been no response. People continue to submit petitions to the authorities.

What did the Bac Ninh Provincial People’s Committee say?

On July 17, Bac Ninh Provincial People’s Committee issued Document No. 2371/UBND-NC responding to people’s petitions. However, the content of the document only answers the part of the contract for the transfer of land use rights between households and Tran Son Company, but does not mention the people’s accusations that this company “turning” agricultural land into residential land.

Specifically, the document of the People’s Committee of Bac Ninh province states: “Because according to the implementation records, households and individuals have agricultural land in the areas of Doc Ngoai, Ma Vai, and Con Gang fields in Phuong Trien village. , Dai Lai commune has been granted a certificate of land use right by a competent state agency; land use period and no dispute, as well as distraint to secure judgment enforcement. Therefore, the fact that households with agricultural land in the implementation area of ​​the Tuynel brick factory project transfer the land use rights to Tran Son Company is in accordance with the provisions of the law.
