Petrobras has an appeal denied at CARF after a fine of R$ 6.5 billion

A Petrobras was fined this Monday, 9th, for Administrative Council for Tax Appeals (Carf) to pay R$6.5 billion.

The fine was applied due to tax issues linked to the activities of Petrobras and affiliates in Netherlands in 2013 and 2014.

The trial was tied, but the state oil company lost in the last instance of the Carfin the Superior Chamber, by casting vote, the vote of the president that breaks the tie.

The 2018 assessment charges Income Tax (IRPJ) e Social Contribution on Net Profit (CSLL) on profits earned by a subsidiary in Netherlands.

Petrobras wants to appeal fine decision

Petrobras argued that this taxation on profits earned would not be possible, as in this case, it would be based in a country that is protected by treaties against double income taxation.

Not so much, IRS Brazilian understands that article 74 of Provisional Measure (MP) 2,158, of 2001, would authorize this taxation.

A Petrobras informed that it will evaluate the adoption of other appropriate measures with the Carf with a view to canceling the fine.

A state explained in a note that the expected loss of this contingency was considered possible in its financial statements, being the purpose of an explanatory note, not implying provisioning.

According to several financial market analysts, the fine should not affect dividends distributed by Petrobras.
