The deal was offered to people who were arrested in front of the Army headquarters on January 9, one day after the invasion of the Three Powers. People accused of serious crimes, considered the executors of the acts, cannot conclude agreements of this kind. “In these cases, the defendants are being judged by the Plenary of the STF”, says the PGR.

Removing social media is another prerequisite for the agreement. They must also participate in “Democracy, Rule of Law and Coup d’Etat”, designed to reduce the radicalization of those accused of coup acts.

300 hours of social service must be completed, with a minimum of 30 hours and a maximum of 60 hours per month.

The fine varies from R$5,000 to R$50,000, depending on the financial condition of the accused..

The clauses also provide that defendants refrain from any criminal practice or conduct already provided for in the criminal action targeted by the agreement and establish that they cannot be prosecuted for another crime or criminal misdemeanor until full compliance with the ANPP [acordo de não persecução penal].

The first settlement of its kind had been offered to ten defendants. Once the proposed agreement has been received, the defense of the accused person has 10 days to confirm interest through the Federal Public Ministry’s petition system.
