Towards a loss of parental authority? The Secretary of State for Children, Charlotte Caubel, in any case mentioned on Monday a potential withdrawal of “digital parental authority in the event that a parent “abuses the image of their children”, during the launch of the campaign to raise awareness of cyber security issues. “Today, a parent can no longer not conceive of digital technology in the exercise of parental authority,” she declared, reports BFMTV.

During her speech, Charlotte Caubel defended a bill proposed by Renaissance MP Bruno Studer, “aimed at guaranteeing respect for children’s image rights”. This text provides in particular for the establishment of the question of private life in the definition of parental authority. It must be debated in a new reading this Wednesday by the National Assembly, according to the website of the latter.

A potential withdrawal of the child’s image rights

This text also provides for authorizing a judge to grant the exercise of the child’s image rights to a third party, in the event of an attack on the “dignity or moral integrity” of the child. “When the dissemination of the image of the child by his parents seriously undermines his dignity or moral integrity, the individual, the establishment or the departmental social assistance service “childhood who has taken in the child or a member of the family may also refer the matter to the judge for the purpose of having the exercise of the child’s image rights delegated to them”, is it stated more precisely in article 4 from the first version of this bill.

In May 2023, the influencer Poupette Kenza was, for example, accused of broadcasting images of her children on the networks by the Renaissance du Rhône MP, Sarah Tanzili. According to her, these photos are similar to child pornography. Poupette Kenza then denied the facts.

If so much vigilance is required, it is because “50% of the photos published on child pornography forums are photos taken by parents and shared publicly on their social networks,” Laura Morin, national director of l’Enfant bleu, an association fighting against abused children.
