Police indict three involved in fan fights for crimes in rail transport

The Civil Police of the State of São Paulo indicted and asked for the preventive arrest of three São Paulo Futebol Clube fans, involved in a fight with Vasco fans at Pinheiros station on lines 4-Yellow and 9-Esmeralda of ViaQuatro/ViaMobilidade respectively.

According to the Occurrence Bulletin, the detainees were involved in two different confusions, being framed in three crimes, two consummated and one attempted, those of Danger of Railway Disaster (art. 260) and Promoting Tumult (art. 41-B of the Statute of the Fan). In addition, the attempt to cause bodily harm (art. 129) against the concessionaire’s security guards.

According to witnesses at the police station, it was reported to the police authority that the problems started after the end of the match, when the fans were escorted back home and “they report that, in this act of boarding at the São Paulo-Morumbi station, there was a disruption of order in which some fans began to chant songs inciting violence, inciting violence against subway employees and other objects inventoried as property of the concessionaire (being treated as public property). He reports that at this moment, São Paulo supporters started body fight attacks against agents; in addition to the destruction of trash cans, railings and flow dividers (patrimony equivalent to public patrimony, since they are affected by the execution of public passenger transport)”, with the three fans inciting acts of violence and vandalism.

According to the Police in the bulletin, the three named as perpetrators of these crimes “promoted and incited riots and violence on the way back from the sporting event, especially in the vicinity of the São Paulo-Morumbi subway station, according to the testimony of the subway security agents; they tried to injure the physical integrity of the railway safety agents, without success, due to circumstances beyond their control; and, lastly, would have impeded or disturbed railroad (or railroad) service by doing acts that could result in disaster.”

With the presence of a lawyer, those identified as authors of the criminal acts, reported in a statement that they did not participate in acts of vandalism or violence, being in the place because they were making their way back to the house, with no connection with the turmoil.

“They did not participate in the riot at the Morumbi station and did not incite violence or attack the station guards; however, they were in the turmoil, as they intended to return to the house. Immediately, they went to Pinheiros station and when they arrived there was already a riot and a rush of users, claiming that some Vasco fans were trying to invade the train station, including throwing stones. They clarify that they went to the platform, but did not invade and traveled on the train tracks; as well as, also, would not be in possession of bombs and rockets. So, too, they would not have attacked the physical integrity of security guards and agents. Asked by this Police authority if they are members of organized supporters, they refused to answer, expressing an interest in only pronouncing in court”, says part of the police document.

In view of the reports and hearings of witnesses and defendants, the Civil Police asked that the preventive detention of those involved be maintained at a custody hearing.

As shown the Transport Diarythe confusion at the station involving São Paulo, Vasco da Gama, concessionaire security and the Military Police, caused inconvenience to passengers with delays in train service and put everyone at risk.
