Yesterday (Wednesday), the Knesset plenum approved a preliminary reading of a bill that would expand the responsibility for preventing sexual harassment in workplaces, so that service providers will also be responsible for preventing sexual harassment of female and contractor employees in the workplace, including service workers such as cleaning, security and catering workers.

The bill was submitted by Knesset members Shashi Guetta (Likud) and Sheli Tal Miron (Yesh Atid), and a similar proposal by MK Merav Michaeli (Labor) was attached to it. It was supported in the plenum by 20 Knesset members with no dissenters or abstentions, and it will be forwarded for discussion In the Committee for the Advancement of Women’s Status and Gender Equality.

According to the proposal, the applicability of the law to prevent sexual harassment will also be extended to employees of a service contractor employed by a service customer. It is also proposed to establish that sexual harassment of an employee of the aforementioned service contractor will be considered harassment while taking advantage of abusive relationships within the framework of work. As part of this, it is proposed to add to the law definitions of “practical employer”, “manpower contractor”, “service orderer” and “service contractor”, so that its instructions are clear with regard to the applicability of tripartite employment relationships (employee, employer, and personnel company) .

In the explanation of the proposal, it is written: “Sexual harassment at work is seen by the legislator to be aggravated in view of the high percentage of sexual harassment in the workplace and due to the fact that it is a hierarchical relationship. Section 9 of the law for the prevention of sexual harassment applies the duties imposed on an employer according to this law also to those who employ an employee of a power contractor A person. However, the law ignores a large group of employees who do not receive its special protection within the framework of the employment relationship. These are employees of a service contractor employed by a service orderer.”

It is also stated in the explanation that the employment of service contractor employees is more widespread than the employment of personnel contractor employees, and there is no point in making a distinction between the two groups of employees. “In the organizational hierarchy, service contractor employees are the most junior employees, and there is no reason not to apply the law to the most vulnerable employees in the organization, who will be exposed to sexual harassment without receiving the special protection of the law in the context of labor relations.”
