Preventing the termination of any national contract before paying all its dues

The Ministry of Labor and Rehabilitation of the Libyan government assigned by the House of Representatives has notified all relevant authorities with a circular to all registered employers not to terminate any national contract before paying all its financial dues and granting an end-of-service bonus to the worker.

The ministry confirmed in a statement on its Facebook page that it had noticed through “its monitoring of the labor market that a number of foreign and national companies operating in Libya do not commit to paying the financial dues to Libyan workers upon the end of the contractual relationship.” These dues include, among other things, “paying two months’ salary for every year the worker spent in the service of those companies.”

The Ministry noted that based on the Labor Relations Law No. (12) of 2010 in the texts of its contractual provisions, all relevant parties are notified by a circular to all employers registered with it not to terminate any national contract except after paying all its financial dues and granting the worker an end-of-service gratuity in the amount of (two months’ salary for each year of work as compensation for terminating the contract).
