Property Allocation Dispute Settled by Court

In a recent court case, Advocate PS Mitra Nesha was appointed to assist the court in determining the allocation of property in a succession case. According to Section 42 of the Succession Act, the allocation of property is based on the status of the deceased’s family members.

Advocate PS Mitra Nesha stated, “If a husband dies, his widow and children have a share in the property. If there are no wife or children, the father inherits the property. If there is no father, the mother and brothers and sisters will be heirs.”

In this particular case, the court ruled that when a married son dies, the mother is not entitled to a share in the property. The judges cited the law, stating, “Only the wife and children have a share in the property.”

The court overturned the Nagapattinam district court’s order that granted the mother a share in the property. The judges expressed their appreciation to lawyer Mitra Nesha for assisting the court in reaching a fair and just decision.

The ruling sets a precedent for future succession cases and provides clarity on the allocation of property in such circumstances. It also underscores the importance of seeking legal counsel to navigate complex legal matters.
