According to prosecutor Cristian Aguilar Aranela, the foundation did not meet the minimum requirements to be a recipient of the funds, all of which would have caused the Treasury a loss of 526 million pesos.

The Antofagasta Prosecutor’s Office formalized the former Seremi of Housing and Urban Planning, Carlos Contreras, for the crime of repeated treasury fraud. for the signing of four agreements with Tomarte foundation in 2022.

On that occasion, agreements were signed for primary habitability works in camps in the city, using resources from the Minvu Precarious Settlements Program.

The hearing will be resumed this Tuesday in the Antofagasta Guarantee Court, with the request for precautionary measures by the Public Ministry.

According to prosecutor Cristian Aguilar Aranela,The foundation did not meet the minimum requirements to receive the funds, all of which would have caused the Treasury a loss of 526 million pesos.

At the hearing, the prosecutor explained that the former seremi improperly intervened in the process prior to the signing of the agreements, instructing that Tomarte be invited and getting him incorporated into the list of foundations that would be considered to be recipients of public funds in 2022.

Aguilar also reported that Tomarte was established on November 16, 2021, so, at the date of the invitation to sign the agreements, it had been in operation for less than a year.and did not have the necessary experience to become a recipient of such funds.

“Thus, with his actions, the accused Carlos Contreras abused his position as Seremi of Housing of the Antofagasta Region and, consequently, the public function he performed, intervening in acts inherent to his position and with serious violation of the duties of the same in the signing of agreements for the transfer of funds to the Tomarte Cultural Foundation, referring to the Precarious Settlements Program of the Ministry of Housing, without it complying with the minimum requirements for this, which resulted in the lack of compliance with the execution of the agreed works, generating fiscal damage amounting to $456 million pesos,” Aguilar indicated at the hearing.
