New Delhi: In a very important decision today, the Supreme Court has said that caste-based reservation is possible in SC/ST reservation. The apex court gave this order while changing the decision in the EV Chinnaiya vs Andhra Pradesh case. While writing the decision, Justice BR Gavai said that there were some flaws in the EV Chinnaiya decision. Here there is a need to understand Article 341 which talks about reservation on seats. He said that I want to say that Article 341 and 342 do not deal with the matter of reservation. The Supreme Court said that quota within quota is not against equality. A bench of Chief Justice DY Chandrachud, Justice Manoj Mishra, Justice Bela M Trivedi, Justice BR Gavai, Justice Vikram Nath, Justice Pankaj Mittal and Justice SC Sharma has given the verdict with a majority of 6-1.

Justice Bela Trivedi gave a different opinion from the majority decision. She wrote in her decision that I have a different opinion from the majority decision. She said that I do not agree with the way the three-judge bench sent this case to a larger bench. The three-judge bench did this without giving any reason.

The Supreme Court, by a majority of 6-1, ruled that states have the power to sub-classify SCs and STs for reservation. The court said that the basis for sub-classification of SCs and STs for quota should be justified by the states on the basis of standards and data.
