‘Rahul Gandhi’s election victory should be annulled’; Saritha S Nair’s petition was dismissed

New Delhi: The Supreme Court rejected the petition filed by Saritha S Nair, the accused in the solar case, questioning the election victory of Rahul Gandhi MP from the Wayanad Lok Sabha constituency. The petition was dismissed during the tenure of Chief Justice SA Bobde. The petition was rejected by imposing a fine of Rs. The court also criticized Sarita’s lawyer for not appearing regularly.

But Saritha S Nair once again applied to restore the petition, pointing out that her lawyer had faced a technical hurdle to participate in the court proceedings through video conference. The court accepted this request and rejected Sarita’s plea today after considering its merits.

The petition demanded that fresh elections should be held in the Wayanad Lok Sabha constituency. The Kerala High Court had earlier rejected Saritha’s petition. Saritha was nominated to contest the 2019 Lok Sabha elections from Wayanad. This was rejected by the electorate. Saritha had decided to contest against Rahul Gandhi of Congress. The nomination papers were rejected on the grounds that the Perumbavoor and Pathanamthitta courts had sentenced Saritha in connection with the solar case. Apart from Wayanad, Saritha Patrika was also filed in Amethi, which was Rahul’s constituency. Amethi’s nomination papers were also rejected. Saritha claims in the petition that the Sessions Court has stayed the conviction against her and that she is entitled to contest.
