Referral suspension against the decision of the CPPAP: the court gives reason to FranceSoir

PRESS RELEASE – The judgment of the Administrative Court of Paris has just fallen. By a decision dated January 13, 2023, the latter has just ruled in favor of FranceEvening and pronounced the suspension of the decision of December 5, 2022 by which the CPPAP refused the renewal of the registration in its registers of our site as an online press service “until a decision is made on the merits of the legality of this decision”.

Also, in the meantime, the judicial body enjoins the CPPAP “to restore the aid scheme from which the site benefited prior to the decision refusing the renewal of its approval”. The newspaper’s request was granted that a priority question of constitutionality be sent to the Council of State, which should deal with the subject of the legality of the existence of the CPPAP.

In its press release, the Administrative Court of Paris underlines that the judge in chambers has “considered that the plea alleging that the CPPAP would not have ruled in all impartiality during its meeting of November 30, 2022 on the application for renewal of the authorization held by the site francesoir.fr was proper to create, in the state of the investigation, a serious doubt about the legality of the contested decision”.
