FAJAR.CO.ID, JAKARTA — Member of the General Election Supervisory Body (Bawaslu) Lolly Suhenty said that regional heads who transfer State Civil Apparatus (ASN) officials ahead of the 2024 Simultaneous Pilkada are threatened with administrative and criminal sanctions.

This was reaffirmed following the recent cancellation of the inauguration and oath-taking of 39 people within the Sleman Regency Government consisting of Primary High Officials, Administrators and Supervisors by the Regent of Sleman Kustini Sri Purnomo on March 22 2024 and was deemed to have violated statutory provisions.

The reason for the cancellation of the inauguration is that it has exceeded the deadline for the inauguration determined by law. This refers to Article 71 paragraph (2) of Law Number 10 of 2016 which states that the Governor or Deputy Governor, Regent or Deputy Regent, and Mayor or Deputy Mayor are prohibited from replacing officials six months before the date of determining the candidate pair until the end term of office unless written approval is obtained from the Minister.

“This is definitely an alleged violation in the nature of election administration. If it is true that there is a violation, the consequence is that the person concerned will not meet the requirements to take part in the Pilkada contestation. We will check again later,” said Lolly, Saturday (6/4/2024).

Meanwhile, Article 190 explains that officials who violate the provisions of Article 71 paragraph (2) or Article 162 paragraph (3) will be punished with imprisonment for a minimum of one month or a maximum of six months and/or a fine of at least IDR 600,000 or a maximum of IDR 6,000. 000.
