“A logical as well as legal absurdity, with profound repercussions on the health of the people of Puglia. A short while ago, the President of the TAR Lecce Antonio Pasca, suspended until September 4th a sacrosanct resolution of the ASL of Brindisi, with which the San Raffaele Foundation was excluded from the management of the Rehabilitation Center of Ceglie Messapica, because the doctors in service do not possess the professional qualifications to treat people in need of intensive rehabilitation.
I don’t think President Pasca would have done the same thing if it was one of his relatives who needed treatment.
On Monday I will report the case to the Presidency Council of Administrative Justice.
After learning of the insufficiency of all the clinical-organizational requirements, what should the Region and the ASL have done, according to the President of the TAR? Applause? Wait for the hearing on September 4? And in the meantime, perhaps pray to the good Lord to keep the patients free from illness or even death?
Justice and its administration are difficult matters and therefore always subject to criticism, there is no doubt, but this difficulty cannot exceed the threshold of abnormality.
In the Rehabilitation Center of Ceglie Messapica, a public facility, owned by the ASL Brindisi, but managed by a private individual in a management experiment assigned illegitimately, it is not even conceivable that a Court would authorize the continuity of the activity, prohibiting the ASL from intervening, with a staff of doctors without the appropriate qualifications and specializations. If in a TAR there cannot be a President without a law degree, how is it possible that in a hospital there can be doctors without a specialization diploma in the specific discipline required by law?
I am perplexed by so many absurdities. And even if I cannot access even easy background information, I ask myself: should something happen until September 4, who will answer for the inappropriate care of patients? The TAR of Lecce?
I have therefore asked the regional legal office to request the revocation of the decree issued today by President Pasca, hoping that the matter will be treated with balance and without the temptation of proud and vindictive affirmation of one’s actions, because here health is at stake”./press release
